General Terms of Use (GTU)

These General Terms of Use (hereinafter "GTU") govern the use of the MesRecettes.ch service. By creating an account or using the service, you acknowledge having read these GTU and accept them without reservation.

1. Operator and purpose of the service

The MesRecettes.ch service is operated by DSTec (sole proprietorship), David Sissaoui, Bahnhofstrasse 43, 3185 Schmitten (FR), Switzerland, tel. +41 71 526 61 16 (hereinafter "the operator").

MesRecettes.ch is a personal online recipe management service. It allows you to import, organise and browse your recipes in a private space. The service is provided free of charge, with a paid Premium option.

The operator endeavours to keep the service accessible at all times but does not guarantee any minimum availability. Interruptions for maintenance, updates or technical reasons may occur without prior notice.

2. Registration and account

A valid email address is required to create an account. You must be at least 16 years old to use this service. Each person may only hold one account.

You agree to provide accurate and up-to-date information upon registration. You are responsible for the confidentiality of your login credentials and for all activity carried out from your account.

3. Personal use and copyright

Strictly personal use: This service is intended for your private use only, within the meaning of Art. 19 CopA. You may not publicly share, redistribute or commercially exploit saved recipes.

Copyright compliance: You warrant that you have the necessary rights to any content you import or publish (recipes, photos). Recipes imported from third-party sites remain the intellectual property of their respective authors. You agree to comply with the Swiss Federal Copyright Act (CopA) and related rights.

Indemnification: In the event of a third-party claim related to content you have imported or published in violation of copyright, you agree to indemnify and hold the operator harmless from any liability, costs and damages related thereto.

Role of the operator: MesRecettes.ch acts as a technical host under Swiss case law. The operator does not verify rights on imported content and is not required to carry out general monitoring of content.

4. Ownership and use of your data

You remain the owner of all recipes and data you add to the service. We do not share, sell, or use your content for commercial purposes. Your data is strictly private.

By using the service, you grant the operator a limited, non-exclusive, royalty-free technical licence solely to host, display and back up your content for the purpose of operating the service. This licence terminates upon deletion of your account.

5. Intellectual property of the service

The MesRecettes.ch service, its source code, design, logo and features are the exclusive property of the operator and protected by Swiss law. Any unauthorised reproduction, modification or use is prohibited.

6. Premium option

The Premium option is available for a one-time payment of CHF 4.90 via the payment provider Stripe. It is not a subscription and no recurring payment will be charged.

Premium is non-refundable, except (a) in the event of a lasting inability to access Premium features attributable to the operator, or (b) where mandatory Swiss law requires it. Any refund request must be sent to admin@dstec.ch within 14 days.

7. Prohibited uses

It is strictly forbidden to use this service to:

  • Infringe copyright or other intellectual property rights of third parties
  • Store or share illegal, defamatory, offensive or immoral content
  • Attempt to access other users's accounts or non-public parts of the service
  • Use the service for commercial purposes without prior written authorisation
  • Reverse engineer, decompile or extract the source code of the service
  • Intentionally overload the service infrastructure (automated scraping, excessive requests)

8. Content reporting and removal

If you believe that content hosted on the service infringes your rights, you may send a notification to admin@dstec.ch including:

  • A precise description of the content concerned and its location on the service
  • Evidence establishing the infringement of your rights
  • Your full contact details (name, address, email)

The operator undertakes to examine any legitimate notification without undue delay and to promptly remove any manifestly unlawful content.

9. Limitation of liability

The service is provided "as is" and "as available", without warranty of any kind, express or implied. To the extent permitted by Swiss law, the operator disclaims all liability for:

  • Data loss or service interruptions
  • Content imported or published by users
  • Indirect or consequential damages resulting from use of the service
  • Inaccuracies in recipes imported from third-party sources

As a technical host, the operator is only liable for user content from the point of effective knowledge of its unlawful nature, and only if it fails to act promptly to remove it or make it inaccessible.

This limitation does not apply in the event of wilful misconduct or gross negligence by the operator (Art. 100 CO).

10. Force majeure

The operator shall not be held liable for any failure or delay in the performance of its obligations resulting from force majeure, including but not limited to: natural disasters, Internet infrastructure failures, administrative or judicial decisions, cyberattacks or any other event beyond its reasonable control.

11. Changes to the GTU

The operator reserves the right to modify these GTU. In the event of a substantial change, users will be notified by email at least 30 days before the new terms take effect. Continued use of the service after this period constitutes acceptance. If you disagree, you may delete your account before the new terms take effect.

12. Termination

You can delete your account at any time via the Settings page. All your data will be permanently deleted within 30 days.

The operator reserves the right to suspend or delete an account in the event of a breach of these GTU, after prior notice by email with a 7-day period to rectify, except in cases of emergency or manifestly serious violation.

Termination results in the loss of access to the service and the deletion of data. Clauses relating to intellectual property, limitation of liability, indemnification and jurisdiction shall survive termination.

13. Applicable law and jurisdiction

These GTU are exclusively governed by Swiss law, to the exclusion of conflict of law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The exclusive place of jurisdiction is the Court of the District of Sense, Fribourg, Switzerland, subject to any mandatory forum prescribed by law.

14. Final provisions

If any provision of these GTU is declared null or unenforceable, the remaining provisions shall remain in full force. The invalid provision shall be replaced by a valid provision that most closely reflects its intent.

The operator's failure to exercise a right under these GTU does not constitute a waiver of that right.

These GTU are drafted in French. In the event of a discrepancy with a translated version, the French version shall prevail.
